Terms of service

Rules for using the EazyRental marketplace.
Draft for operators. This is a practical summary to align your team and users — it is not legal advice. Have qualified counsel review and localize it before a public launch, especially for PIPEDA, provincial privacy laws, and housing advertising rules in your provinces of operation.

1. Agreement

By accessing or using EazyRental (the "Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.

Operator. The Service is operated by the business identified on our production site and contact channels (legal name, address, and support email to be confirmed by counsel before public launch). Until that name is finalized in writing, "we", "us", and "our" mean the operator of this EazyRental deployment.

2. The Service

EazyRental provides an online marketplace that helps landlords advertise residential rental listings and helps tenants discover properties, save searches and favourites, request tours, send inquiries, submit rental applications, and use booking tools where landlords enable them.

We are not a landlord, property manager, real estate brokerage, mortgage broker, insurer, escrow agent, or party to any lease unless we explicitly say otherwise in writing. We do not guarantee that any listing is available, accurate, lawful, or suitable. Tenants must verify details in person and with their own advisors; landlords remain responsible for their properties and compliance with law.

No agency. Except where required by law, nothing in these Terms creates a partnership, joint venture, employment, or fiduciary relationship between you and us, or between users of the Service.

3. Eligibility and accounts

You must be the age of majority (or otherwise able to enter a binding contract) in your province or territory and have authority to use the Service on behalf of yourself or your organization. You agree to provide accurate registration information and to keep your credentials confidential. You are responsible for activity under your account unless you notify us of unauthorized use according to the process we publish.

4. Listings and landlord obligations

  • Listings must describe real properties you are authorized to advertise.
  • Information (rent, availability, fees, utilities, rules) should be truthful and updated when it changes.
  • You must comply with applicable human rights, housing, advertising, privacy, and municipal rental rules in each jurisdiction where you list (including anti-discrimination rules).
  • New listings may require administrator approval before appearing in the public catalogue; we may reject or remove listings that violate these Terms or our policies.
  • Host verification (identity document review) is a fraud-reduction measure only. It does not certify ownership of a property, creditworthiness, fitness as a landlord, or compliance with housing law.
  • You are solely responsible for collecting and handling tenant personal information lawfully when tenants contact or apply to you.

5. Tenant and visitor conduct

You agree to use the Service only for lawful rental-related purposes. You will not harass users, submit false applications, scrape the site in a way that harms performance, circumvent security, or misuse another person's identity. You agree to perform your own due diligence before paying deposits, signing leases, or transferring funds.

6. Prohibited content and behaviour

Without limitation, you must not:

  • Post fraudulent, misleading, or discriminatory listings or messages.
  • Upload malware or attempt unauthorized access to systems or data.
  • Send spam or unsolicited commercial messages outside normal landlord–tenant contact.
  • Use the Service to commit crimes or facilitate illegal discrimination in housing.
  • Collect or store others' government ID or sensitive personal information through the Service except as expressly allowed (for example landlord host verification through our designated flow).

7. Moderation and enforcement

We may review listings, investigate reports, suspend or terminate accounts, remove content, and cooperate with authorities when appropriate. We are not obligated to monitor all content but may do so to protect users and the integrity of the marketplace. Decisions may be automated or manual depending on configuration. Published or approved listing status means the listing met our internal publication checks — it is not a warranty that the landlord or property is verified, safe, or lawful.

8. User content and licence

You retain ownership of content you submit. You grant us a non-exclusive, worldwide, royalty-free licence to host, display, copy, and distribute that content on the Service and in operational backups, solely to operate, promote, and improve the marketplace. You represent that you have the rights needed to grant this licence for photos, text, and documents you upload, and that your content does not infringe third-party rights or law.

9. Intellectual property

The Service name, branding, software, and documentation are protected by intellectual property laws. You may not copy our software, frame the site to mislead users, or use our marks without permission, except as allowed by law or express written consent.

10. Third-party services and scores

The Service may link to maps, email providers, payment processors, walkability/transit score providers, insurers, or other tools. Those services have their own terms and privacy policies. Neighborhood scores and similar metrics are estimates for convenience only and are not guarantees of safety, commute time, or quality. Your operator is responsible for configuring integrations appropriately.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION, OR THAT LISTINGS, USERS, DOCUMENTS, SCORES, OR COMMUNICATIONS ARE ACCURATE, COMPLETE, OR NON-FRAUDULENT.

Some provinces do not allow certain disclaimers; consumer rights may apply. Your lawyer should tune this section for the provinces you target.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, DIRECTORS, AND EMPLOYEES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR ANY LISTING, TOUR, APPLICATION, BOOKING, LEASE, DEPOSIT, OR PAYMENT BETWEEN USERS. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE IN ANY TWELVE-MONTH PERIOD IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THAT PERIOD OR (B) ONE HUNDRED CANADIAN DOLLARS (CAD $100), IF YOU PAID NOTHING.

These limits do not apply where prohibited by law (for example certain consumer protection claims). Replace caps and carve-outs with jurisdiction-specific advice.

13. Indemnity

You agree to defend and indemnify us against claims, damages, losses, and expenses (including reasonable legal fees) arising from your content, your listings, your communications with other users, your leases or deposits, your violation of these Terms, or your violation of third-party rights or law — except to the extent caused by our gross negligence or wilful misconduct as finally determined by a court.

14. Termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms, risk to users, or legal requirements. Provisions that by nature should survive (ownership, disclaimers, liability limits, indemnity, governing law) survive termination.

15. Governing law and disputes

These Terms are governed by the laws of Canada and the Province of Alberta, excluding conflict-of-law rules that would apply another jurisdiction's law, unless your operator's counsel designates a different province of incorporation or principal place of business before launch. Courts in that province have exclusive jurisdiction, subject to mandatory consumer protections where they apply. Nothing here prevents you from filing a complaint with the Office of the Privacy Commissioner of Canada or a provincial privacy or consumer authority where you have that right.

16. Changes

We may update these Terms by posting a new version on this page and updating the "Last updated" date. Continued use after the effective date may constitute acceptance where permitted by law; material changes may require additional notice — confirm with counsel.

17. Fees and payments (when applicable)

Some deployments may offer optional paid features (for example promoted placement or landlord tools). Where fees apply, they are charged only according to the checkout or pricing page shown at purchase. Taxes may apply as required by law. You authorize us and our payment processors to charge the payment method you provide for approved transactions.

Rent and deposits. Unless we expressly offer an escrow or rent-collection product in writing, rent, security deposits, and similar amounts are arranged between users. We are not responsible for mishandled deposits, illegal fee practices, or failed private payments.

Unless stated otherwise at purchase, listings and digital services are provided on a non-refundable basis once delivered, subject to our Refund policy and applicable consumer protection law.

18. Disputes between users

If a disagreement arises between a landlord and a tenant — rent, deposits, condition of the unit, lease terms, or similar — those disputes are between the parties. You may use courts, tribunals, or mediation available in your province or territory. We may assist with platform records where lawfully required but we are not obligated to adjudicate private rental disputes.

19. Rental fraud awareness

Criminals sometimes misuse rental marketplaces. We encourage you to verify listings, meet in person when safe to do so, avoid wiring money to strangers, and report suspicious ads using the tools on each listing. See our FAQ for practical tips. We do not guarantee that every listing is legitimate; due diligence is your responsibility.

20. Applications, tours, bookings, and documents

  • A tour request, inquiry, application, or booking request is a communication tool, not a lease and not an acceptance of tenancy by us.
  • Landlords decide whether to accept applicants subject to applicable law.
  • Lease PDFs or other files stored in our tools are for user convenience; we do not provide legal drafting or review of those documents.
